1. Accepting these terms

By creating an account, watching an episode, or publishing a series you agree to these Terms, the Content Guidelines, and the Privacy Policy. If you do not agree, do not use Gasp.

You must be at least 13 years old to hold an account and at least 18 years old to view series rated 18+. We ask you to confirm your age before mature content plays; giving a false confirmation is a breach of these Terms.

2. Accounts and access

Accounts are personal. You are responsible for everything done through yours. You reach the studio by applying as a creator and redeeming the creator invite we send when we approve your application, or by accepting an invite to a studio’s team. Invites are not transferable and we may revoke them at any time.

We may suspend or terminate an account that breaks these Terms, abuses the reporting system or work inquiries, attempts to bypass the paywall, or scrapes the catalogue.

When your account is deleted, your VIP subscription is cancelled at once: nothing further is charged and the current period is not refunded. Your name, email address and handle are removed from your account, along with your favorites, likes and creator page, and unspent coins are lost. If you are the only owner of a studio, the studio closes: its plan is cancelled the same way, its series leave the library and its unspent credits are lost. A studio with another owner carries on without you, and so does its plan. You cannot delete your account while your card pays for the plan of a studio another owner keeps: another owner takes over billing, or the plan is cancelled, first. If your account is deleted some other way, that plan ends at the close of its current period (at once, if its last payment failed), and your card is not charged for it again. A remaining earnings balance is handled as the Creator Payout Terms describe, and the Privacy Policy says which records we keep.

3. Creator content

Everything you generate on Gasp is made with AI models run by third-party providers. You are responsible for the prompts you write and the episodes you publish. You must not create or publish:

• Minors in any sexual, suggestive, or exploitative context, or characters presented as minors in such contexts;
• Real people — their face, voice, name, or recognisable likeness — without their documented consent, including public figures and deceased persons;
• Copyrighted characters, scripts, brands, or trade dress you do not own or have a licence to use;
• content that is illegal where you live, promotes terrorism or self-harm, or targets a protected group with hatred or harassment.

The prompts and descriptions an image or video is made from are screened automatically before we spend anything on it, and the request may be blocked. Requests for AI writing and for voices are not screened before they run, and generated images, and episodes made only of generated video, are not screened afterwards; a person reviews every episode before it goes live. Screening is imperfect; it does not transfer responsibility for your content to us.

If you have studio access, the Creator Terms also apply: your studio and team, generated and uploaded episodes, review, credits and plans.

4. Rights in your content

You keep whatever rights you hold in the scripts, characters, and episodes you create. You grant Gasp a worldwide, non-exclusive, royalty-free licence to host, encode, stream, promote, and display them on and off the platform for as long as they remain published, plus a reasonable period afterwards for backups and logs.

AI-generated output may not be eligible for copyright protection in every country. We make no representation about the ownership or protectability of any output.

5. Viewer rules

Episodes are licensed to you for personal, non-commercial streaming. You may not download, record, re-upload, or redistribute them, nor circumvent signed playback or any other access control.

If you see something that breaks the Content Guidelines, use the report button on the series, in the player, or on a creator’s or studio’s page. Reports are reviewed by a person; abusing the form may cost you your account.

6. Coins, VIP, and credits

Coins unlock episodes one at a time, or every locked episode of a season at once with a season bundle. VIP is a recurring subscription that unlocks the catalogue while it is active. Credits pay for generation in the studio.

• Coins and credits are a limited, revocable licence to access digital content. They have no cash value, cannot be transferred, and expire if your account is terminated for breach.
• All purchases are final and non-refundable, except where a refund is required by the law that applies to you — for example the statutory withdrawal rights of consumers in the EU, the UK, and some other jurisdictions.
• VIP renews automatically at the price and interval shown at checkout until you cancel. Cancelling stops the next renewal; it does not refund the current period.
• A VIP subscription renews at the price it started at for as long as it stays active: until you cancel it and the period you paid for ends, until it ends because a payment failed and was not made up, or until your account is deleted. A subscription cannot be switched to another interval. To change, cancel it and subscribe again once it has ended; a new subscription pays the prices on sale when you start it.
• An unlock, including one in a bundle, lasts as long as the episode is in the library. A series can leave the library, for example when its creator closes their account or it breaks the Content Guidelines.
• Gasp, not the creator, sets one coin price for every episode, how many of the first episodes of every series are free, and the discount on a season bundle, the same for every series; more episodes are free while you are signed in, and all three are shown on the Pricing page. While at least 5 episodes of a season are locked for you, a season bundle unlocks all of them in one purchase for 20% less than unlocking them one at a time. A bundle covers only the episodes of that season that are published and locked for you when you buy it (if your VIP is set to end, the ones that lock when it does); an episode published later is unlocked as usual. We may change these, but an unlock or a bundle is never charged more than the price shown when you choose it.
• Prices for new purchases, coin costs per episode, the season bundle discount, and VIP benefits may change. A price change never applies to a VIP subscription already active, and no change applies retroactively to coins you already hold.

Payments on the web are processed by Stripe. Purchases made inside a future mobile app will be processed by Apple or Google under their terms, and refunds for those purchases are handled by them.

If you publish on Gasp you earn a share of what viewers spend on your episodes. The Creator Payout Terms say how much, how it is worked out, and when and how it is paid.

7. Availability and changes

Gasp is provided “as is”. We do not promise that generation will succeed, that a model will remain available, or that the service will be uninterrupted. We may add, change, or remove features, including pausing generation entirely to control cost or abuse.

8. Liability

To the maximum extent permitted by law, Gasp is not liable for indirect or consequential loss, lost profits, or lost content. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

9. Work inquiries

A creator may take work inquiries through their page on Gasp (“Hire me”), and the owners of a team studio through the studio’s page (“Work with us”); each such page lists the kinds of project it takes on. If you are signed in and have confirmed that you are 18 or older, you can send one of these pages an inquiry about a project: the kind of project, a budget range and a timeline if you choose, and a message.

Gasp reviews every inquiry before it is passed on, only to check that it is a genuine request about a project. When you send one, you agree that, if we approve it, we send it to the creator, or to the studio’s owners, with your name, handle and account email address, so that they can reply to you by email. An inquiry we do not approve is not passed on, and we tell you why, from a fixed list of reasons. The Privacy Policy says what we keep about inquiries and for how long.

Gasp does not vet the people who send or receive inquiries, or any project, offer or agreement that comes of one. We are not a party to anything you agree, and we take and hold no money for it: its terms, the rights in the work, payment and any dispute are between you and the other side. Work published on Gasp is still covered by these Terms, the Content Guidelines and, if you have studio access, the Creator Terms, however it was arranged.

Use inquiries only for genuine projects: no spam, advertising, scams, phishing or harassment. A page can block a sender from sending it more inquiries, and anyone who receives an inquiry can report it to us.
