Creator Terms

If you have access to the Gasp studio, these terms apply to everything you make there: your studio and team, the episodes you generate or upload, how they are reviewed and published, and how credits and plans work.

1. Who this covers

These terms apply to every account with studio access, whether it came from a creator invite or was granted by Gasp, and to every studio that account belongs to. They sit alongside the Terms of Service, the Content Guidelines and the Creator Payout Terms, which all still apply. If these terms and the Terms of Service disagree about something you make in the studio, these terms win.

You accept them once, when you accept a creator invite or the first time you open the studio. You must be at least 18 years old to hold studio access, and you confirm that you are when you accept.

2. Your studio and your team

Every creator has one studio of their own, and may also be invited into other studios, including one Gasp sets up, which they may own alongside their own. A studio owns its series, its credits, its plan and its earnings; a person who belongs to several studios works in one at a time. Your studio starts as a personal studio; on a plan with more than one seat you may turn it into a team and invite people. It stays a team afterwards.

  • The owner of a studio is responsible for it: for what its members publish, for its spending, and for keeping its billing and payout details accurate. Only the owner buys credits or a plan for the studio and sets up its payouts.
  • Members act for the studio. What a member generates spends the studio’s credits, and what a member publishes is published by the studio. Add only people you trust to spend and publish in your name; you can remove a member at any time.
  • Seats. A studio’s plan says how many people may work in it, the owner included. If the plan later has fewer seats than the studio has people, or an owner Gasp invited joins a studio whose seats are all taken, the newest members are paused: they can still read the studio’s work and leave it, but not change or generate anything, until the plan rises or someone leaves. Nobody is removed by a plan change.
  • The studio’s handle and name must not impersonate another person, studio or brand. Words reserved for the platform cannot be used as handles.
  • Work inquiries. A creator may take work inquiries through their creator page (“Hire me”), and a team’s owners through the studio’s page (“Work with us”), listing the kinds of project they take on; Gasp’s own studio takes none. Gasp reviews each inquiry first, only to check that it is a genuine request about a project. An approved one reaches the creator, or every owner of the team who is not suspended (never its members), by notification and by email, with the sender’s message, name, handle and account email address, and a reply to that email goes to the sender. The owners answer for their studio’s inquiries and for anything the studio agrees through one. Gasp does not vet the sender or the project, is not a party to what you agree, and takes and holds no money for it, as section 9 of the Terms of Service says. You can block a sender from your page, and report an inquiry to us.

3. Generated episodes

The studio turns your idea into a series bible, scripts, images, voices and video with AI models run by third-party providers. Every generation is a request you make: nothing is generated, and nothing is charged, until you click a button that shows its price.

  • You are responsible for every prompt, description, script and reference image you provide, and for every episode you publish. The limits in section 3 of the Terms of Service apply: no minors in sexual or exploitative contexts, no real people without their documented consent, no copyrighted characters, scripts, brands or trade dress you do not hold rights to, and nothing illegal or hateful.
  • The prompts and descriptions an image or video is made from are screened automatically before we spend anything on it, and a blocked request costs you nothing. Requests for AI writing and for voices are not screened before they run. Screening is imperfect; it does not make us responsible for what you asked for.
  • Generated output is probabilistic. We do not promise that a given image or clip will match your description, that two generations will agree with each other, or that a model will remain available. A generation that fails is not charged; one that completes is charged whether or not you like the result.
  • We may switch off or withdraw any model. A generation already started on it still finishes, and what it made stays in your studio. A shot that names a model that is no longer offered must pick another before it renders again.
  • Reference images you upload (a style, a face, a place) must be yours to use in this way. Uploading a photograph of a real person as a character reference requires that person’s consent.

You keep whatever rights you hold in your prompts, scripts, characters and the episodes you make, and you grant Gasp the licence described in section 4 of the Terms of Service. Because the output is machine-generated from models shared with every other creator, we cannot promise that it is protectable by copyright where you live, or that a similar image, voice or clip will never be generated for someone else. The model providers’ own terms apply to their output and may change; we pass on any restriction they place on us.

4. Uploaded episodes and cuts

Studios on a plan may also publish episodes made elsewhere and uploaded as finished video. They may also replace a generated episode’s video with their own cut of it: an edit of that episode’s clips made outside Gasp, which may trim and reorder them and add transitions, titles, captions and music. A cut must be built from that episode’s clips. And they may upload a clip for a single shot of a generated episode, as one of its takes: it must be footage made with an AI tool, never filmed footage. Before an upload starts you confirm that:

  • you own, or have licensed for use on Gasp, every right in the video: the footage, the music, the performances, the script, and the likeness of every person who appears or is heard in it (for a cut, in everything you added to the episode’s clips);
  • the video meets the Content Guidelines and you have rated it honestly;
  • you will provide evidence of those rights (releases, licences, clearances) within a reasonable time if we ask for it.

The minutes a studio may publish from uploads (cuts and uploaded clips included) are limited by its plan, shown on the pricing page and in the studio. A cut keeps playing as uploaded when the episode’s shots change afterwards, until it is replaced by a new cut or an export of the shots. An upload that cannot be processed, or that our automated frame check flags, waits for a human review before it can be published.

5. Review and publishing

  • Every episode is reviewed by a person before it goes live. You submit it for review from the studio; we approve it, or send it back with a note saying what to change. You can withdraw a submission, and unpublish a live episode, at any time. You can also pick a later date and time for it to go live: approved before then, it stays locked and goes live at that time, and you can release it early or take it off the schedule, which sends it back for review.
  • A published episode is licensed to viewers under the Terms of Service. Its number and address never change, so a link keeps working while it stays published.
  • We may mark, suspend or remove any series or episode that breaks these terms or the Content Guidelines, or that we receive a valid copyright notice about; we remove one only once it, or its series, has been suspended. We may take down a season’s Coming soon card, hide a creator’s or a studio’s page that breaks them, change a creator’s or a studio’s name or handle that does, and pause generation for the people involved. A suspension, a removal, a card taken down, a hidden page, a name change and a generation pause each come with a notification and an email that give the reason, and you can reply to that email or write to us to appeal any of these. When a suspension, a hidden page or a pause is lifted, you get another notification and email saying so. When we change a name or handle, the name and handle (and a personal studio’s name) stay locked until we lift the lock, and when the handle changes we hold the old one so that it cannot be claimed until we release it.
  • A series generated in the studio is tagged “AI generated” beside its genre or episode count wherever it is listed, and says on its page that it was generated with AI. Do not present generated footage as a real recording of real events, and do not label an uploaded episode as generated, or a generated one as filmed.

6. Credits and plans

Generation is paid for in credits, which belong to the studio. Every button that spends credits shows its price first.

  • When you start a generation its price is held from the studio’s balance; it is taken when the generation completes and released if the generation fails. A hold that is neither taken nor released, because something went wrong on our side, is released automatically.
  • Brainstorm replies and story pitches are free on the free chat models, when Gasp offers any, and need no credits, up to the number of free calls a day Gasp sets for each person (a day in UTC). That number is shared by all the free chat models, and the message box shows how many are left; past it, and on any other model, replies and pitches are charged like any other generation. Gasp chooses the free chat models and the daily number, and may change them or stop offering free chat at any time. Free chat goes on while a studio’s spending is paused because its plan ended, but not while Gasp has paused the studio’s spending.
  • Credits are bought in packs, granted with a plan, or granted by Gasp. They have no cash value, cannot be transferred between studios or withdrawn, and expire if the studio is closed for breach. Purchases are final as described in section 6 of the Terms of Service.
  • A plan is a monthly or annual subscription. It grants the studio credits each month, on an annual plan too, and the limits shown for it on the pricing page. A studio needs a plan to start a series.
  • Gasp may instead provide a plan for a studio it set up: its own studio, or another for a trial or under a separate agreement. A plan Gasp provides sets the limits of the plan it names while it applies, except that outside Gasp’s own studio the studio renders at most 4 shots at once and may have at most 60 minutes of uploaded video live at once. It grants no monthly credits, nothing is billed for it, and credit packs bought on it are at list price. Gasp may also provide a dated plan for a studio whose first owner is on Gasp’s staff; its owners are not told when it starts, only a week before it ends and when it ends.
  • A plan Gasp provides lasts through the last day Gasp gives it (in UTC), if any, or until Gasp ends it. The studio’s owners are told when it starts or changes, a week before a dated plan ends if it had more than a week to run, and when it ends. When its last day is over or Gasp ends it, the studio has no plan and, outside Gasp’s own studio, its spending is paused until the studio has a paid plan or Gasp provides one again; its credits, those it bought included, its series and its episodes stay. A paid plan bought for the studio replaces a plan Gasp provides from the moment the paid plan starts, even a smaller one.
  • Plan credits roll over up to 3 months’ worth of the plan’s monthly grant. A grant only tops the studio’s plan credits up to that ceiling, and the remainder of that grant lapses. Spending draws on plan credits before credits the studio bought; bought credits are not counted toward the ceiling and do not lapse.
  • Gasp may pause spending in a studio, which stops its renders, exports, AI writing, voices and video uploads and its credit pack purchases, and tells the owners why; work queued that had not started is stopped and its credits released. Credits stay in the balance while spending is paused, and episodes already exported can still be published.
  • Moving up a plan grants the difference in monthly credits at once. Cancelling a plan stops the next grant and does not refund the current month.
  • Provider prices change and models come and go. We may change credit prices, the pack sizes and the plans; a change never rewrites a charge already made, and a click never costs more than the price it showed: if the price has gone up since, nothing is charged and you are shown the new price.

7. What you earn

A studio earns a share of what viewers spend on its episodes. Gasp, not the creator or the studio, sets the coin price of every episode, how many of the first episodes of every series are free, and the discount on a season bundle (the locked episodes of a season unlocked in one purchase), the same for every series, and may change them. The Creator Payout Terms say how much, how it is worked out, and when and how the studio’s owner is paid. A team’s earnings are paid to the payout account its owner set up, and every owner is told by email when someone starts setting up a payout account or replaces it. If that owner steps down or leaves, payouts pause and the balance carries forward until a remaining owner sets up a new payout account. When Gasp changes a studio’s owners, the studio’s next payout is held for one close, as the Payout Terms describe.

Money from work arranged through a work inquiry (section 2) is not earnings: it is paid between you and the person you work with, never through Gasp, and Gasp takes no share of it.

8. Leaving, archiving and closing

  • You may archive or delete a series you have not published. A published series is archived rather than deleted, and a published episode, or one a viewer has paid to unlock, cannot be deleted by you; unpublish it instead. Records of payments, unlocks and generation are kept as the Privacy Policy describes.
  • A member may leave a studio at any time; the studio’s series, credits and earnings stay with the studio. An owner may hand the studio on by making another member an owner, and Gasp may make a member an owner or an owner a member from its admin tools, telling that person and the studio’s owners; a studio always keeps at least one owner.
  • We treat the owner who bought a studio’s plan as the one paying for it until another owner takes over billing, which puts their own card on the plan. Leaving a studio, or no longer being its owner, does not take your card off its plan. While your card pays for the plan of a studio that carries on without you, you cannot delete your account until another owner takes over billing or the plan is cancelled; if your account is deleted some other way, the plan ends as section 2 of the Terms of Service describes.
  • If we close a studio or an account for a breach of these terms, its unspent credits are forfeited and its published episodes come down. Earnings from content in breach may be withheld as the Payout Terms describe.

9. Changes

We may change these terms as the studio changes. We will post the new version here with its date and tell you in the studio; continuing to generate or publish after that date accepts the change.
